Fair point, but given the information publicly available, he is setting up a museum, it seems unlikely that he is doing what some have accused him of, and is acting within his rights.

A poster has claimed without evidence that the ownership of 3442 was transferred under certain conditions - that the locomotive should be painted a certain colour and that it should remain operational - and that those conditions have been deliberately breached. Whether his claims are correct or not is beside the point: it is a prima facie accusation of breach of contract and as such, it is actionable unless the poster in question can prove his claims. I would remind that poster and others that in both English and Scots law "A is liable for saying anything to C about B which would be apt to make the average citizen think worse of the latter." In other words, if you publish anything which might negatively affect the reputation of a named person then that is libel, and one poster in particular has libelled John Cameron in this thread, and he has aggravated that libel by making further defamatory statements as to Mr Cameron's character.

I strongly advise that all posts by that individual and certain others, and all references to those posts including this one, be deleted and that this thread be locked until certain individuals have calmed down.

Is it tho? Its only us lot on here that care so much about historical accuracy. I agree that it would be great to have the loco on the line for which she was built, but when you are an American/Chinese/any other ethnicity tourist, going to see the harry potter train in wildest Scotland, K4, B1, Black5, it makes zero odds to you, in the overwhelming majority of cases.

Complete tangent (but good grief this thread needs one before people find themselves in court!) Easy to tell the difference, entirely different cab arrangement.

Are you representing Mr Cameron and do you have the intention to take this case forwards before the courts?

If not, pipe doon! Its conjecture, on a forum, on THE INTERNET!

I bet you are a riot at party's!

Err, you are aware that THE INTERNET don't know if this is actually different from the internet, but let's assume 'shouting' doesn't change what it is we are talking about) is very much 'publishing' and actually, yes, both the poster and the Forum Owner could be sued for something posted on this site - as the Forum Owner has had such threats (completely unrelated to this topic AFAIK) in the past.

You mean one has a space where other railways have cab doors?! :D I know there's a few differences between the 2 7325 had/has balance weights on its buffer beam something to do with trying to wear the leading pair of driving wheels isn't it?

Quite so, but evidently certain people think that the law does not apply to them.
